  • By ordering any of our products, you agree to be bound by these terms & conditions.
  • By placing an order at Orpland, you warrant that you are at least 18 years old or have parents’ permission to buy from us.
  • All personal information you provide us with or that we obtain will be handled by Orpland as responsible for the personal information.
  • Events outside Orpland’s control shall be considered force majeure.
  • The price applicable is that set at the date on which you place your order.
  • Multiple orders of international Orps and REMORPS are limited to 3 Orps and/or 3 REMORPS per shipping charge
  • Shipping costs and payment fees are recognized before confirming the purchase.
  • Customs and Duty fees may be applicable  in your country and are outside the control of Orp Industries.
  • Card information is transmitted over secure SSL encryption and is not stored.
  • Please note that local charges may occur.
  • The Orp limited warranty only extends to purchases from Orp Industries, orpland.com and authorized dealers.  Products sold on Amazon, Ebay and similar aggregators are not authorized.
  • Orpland reserves the right to amend any information without prior notice.

By placing an order at Orpland, you warrant that you are at least 18 years old (or have parents’ permission to buy from us) and accept these terms & conditions which shall apply to all orders placed or to be placed at Orpland for the sale and supply of any products. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.

Consumer Sales Terms

These Consumer Sales Terms apply to your purchase of Orp Industries’ products. PLEASE READ THIS DOCUMENT CAREFULLY! IT CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS. THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT ORDER OR KEEP YOUR PRODUCT.

By placing an order or keeping and using a product, you agree to be bound by these terms. If you have already placed your order and do not agree with these terms, then you must return your purchase within 30 days, in accordance with Orp’s Return Policy. These terms may NOT be altered, supplemented or amended by any other document unless the new document is signed by both you and Orp. In addition to this document, Orp’s Return Policy and 90 Day Limited Warranty may apply to your purchase.

Terms of sale

  • Product Orders: All orders placed through the Site are subject to our acceptance. If your credit card has already been charged for an order that we later cancel (because the product is no longer available or otherwise), we will issue you a refund.
  • Pricing: We work hard to ensure our website is up-to-date, but sometimes typos or other mistakes happen. Orp is not responsible for these types of errors or miscommunications.
  • Electronic Payment Vendors: Some payments may be processed through electronic payment vendors. Your relationship with any electronic payment vendor is separate from your relationship with us and is governed by the terms and conditions contained in the vendor’s agreement and posted on their website.
  • Shipping: Currently, we ship anywhere in the United States and certain parts of the world where the USPS will ship. Products usually ship within 2-3 days after we receive your order.

Taxes

You are responsible for all sales, use, or value-added taxes associated with the products your purchase.

Limitation Of Liability

Bicycle riding is an inherently dangerous activty. Wear a helmet, always look both ways, and generally exercise caution when cycling on roadways. While the Orp product can help minimize those inherent risks, it cannot guarantee your safety. YOU ACKNOWLEDGE THAT ORP SHALL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OF ANY KIND CAUSED BY ANY REASON, WHETHER BREACH OF CONTRACT, NEGLIGENCE, STRICT TORT LIABILITY, OR OTHERWISE. IN NO EVENT WILL ORP INDUSTRIES BE LIABLE TO YOU IN AN AMOUNT EXCEEDING THE PURCHASE PRICE OF THE PRODUCT. ANY LAWSUIT AGAINST ORP INDUSTRIES SHALL BE FILED WITHIN ONE YEAR FROM PURCHASE OF THE SUBJECT PRODUCT. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OR OF ANY LIMITED REMEDY PROVIDED HEREIN. Some states do not allow the exclusion or limitations of consequential or incidental damages, so these limitations or exclusions may not apply to you.

Modifications

We may modify these terms and conditions from time to time. By subsequently placing an order with use or accepting our products, you acknowledge and agree that you accept the terms as then in effect.

DISPUTE RESOLUTION AND BINDING ARBITRATION
YOU AND ORP AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A STATE OR FEDERAL COURT OF LAW OR TO HAVE RIGHTS DETERMINED BY A JURY, OR TO PARTICIPATE IN A CLASS ACTION WITH RESPECT TO ANY CLAIM RELATING TO OR ARISING OUT OF YOUR PURCHASE OF ORP PRODUCTS. ANY CLAIM OR DISPUTE BETWEEN YOU AND ORP ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF A PRODUCT OR THIS AGREEMENT SHALL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION. The arbitrator shall have exclusive authority to resolve any dispute relating to enforceability of this arbitration provision including any unconscionability challenge. The arbitration shall be administered by the Arbitration Service of Portland (“ASP”), in Portland, Oregon according to then-current ASP rules. Information on ASP is available at http://www.arbserve.com/. Consumer claimants (individuals whose transaction is intended for personal, family or household use) may elect to pursue their claims in small-claims court rather than arbitration. The arbitration or small-claims court proceeding will be limited solely to the customer’s individual dispute or controversy.

If the class action waiver provision of this arbitration agreement is deemed invalid or unenforceable, then this entire arbitration agreement will be deemed invalid or unenforceable. The arbitrator will have the right to award any relief deemed proper in the circumstances, including, without limitation, money damages injunctive relief, and attorneys’ fees and costs, provided that the arbitrator will not have the right to award exemplary or punitive damages. This transaction shall be governed by the Federal Arbitration Act. Any award of the arbitrator(s) shall be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction. The prevailing party in any arbitration will be entitled to recover all reasonable attorneys’ fees and other expenses (in addition to statutory “costs” of litigation), including attorneys’ fees and expenses in connection with any appeal or petition for review.

You have the right to opt-out and not be bound by this arbitration agreement by sending written notice of your decision to opt-out to: ORP INDUSTRIES, 1415 SE 8th Ave., Portland, OR 97214. The notice must be sent within thirty (30) days of your initial purchase from Orp. If you elect to opt-out of this arbitration provision, Orp will not be bound by it, either.

These terms, any sales thereunder, or any other claim or controversy (whether in tort, contract or otherwise) between you and Orp shall be governed by the laws of the state of Oregon, exclusive of choice of law rules.

Personal Information

All personal information you provide us with or that we obtain will be handled by Orpland as responsible for the personal information. The personal information you provide will be used to ensure deliveries to you, the credit assessment, to provide offers and information on our catalog to you. The information you provide is only available to Orpland and Tictail and will not be shared with other third parties. You have the right to inspect the information held about you. You always have the right to request Orpland to delete or correct the information held about you. By accepting the Orpland Conditions, you agree to the above.

Force Majeure

Events outside Orpland’s control, which is not reasonably foreseeable, shall be considered force majeure, meaning that Orpland is released from Orpland’s obligations to fulfill contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

Payment

All products remain Orpland’s property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognized before confirming the purchase. If you are under 18 years old you must have parents’ permission to buy from Orpland.

All transfers conducted through Orpland are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway choosen for the transaction as they are responsible for the transactions made.

Local Taxes

Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers own expense.

Cookies

Orpland uses cookies according to the new Electronic Communications Act, which came into force on 25 July 2003. A cookie is a small text file stored on your computer that contains information that helps the website to identify and track the visitor. Cookies do no harm to your computer, consist only of text, can not contain viruses and occupies virtually no space on your hard drive. There are two types of cookies: “Session Cookies” and cookies that are saved permanently on your computer.

Orp Industries 1 Year Limited Warranty

What This Warranty Covers
This warranty provides the sole remedy for any claims asserting any defects in material or workmanship in Orp products.

Who Is Covered By This Warranty
This warranty extends to the original consumer purchaser of the product only. All warranty requests require proof of purchase (dated receipt or packing slip).

How Long This Warranty Lasts
The warranty lasts for 1 Year from date of purchase.

What Orp Industries Will Do
We will repair or replace the defective Orp product, or refund the purchase price you paid for the product, at our choice. Orp may replace your product with a comparable product from the current product line. THIS IS YOUR SOLE AND EXCLUSIVE REMEDY UNDER THE WARRANTY.

What This Warranty Does Not Cover
THIS WARRANTY EXCLUDES DAMAGE OR PRODUCT MALFUNCTIONS RESULTING FROM HEAT, ABUSE OR MISUSE, NEGLECT, IMPROPER REPAIR, IMPROPER FIT, ALTERATIONS, ACTS OF GOD, OR OTHER CAUSES NOT ARISING FROM DEFECTS IN MATERIAL OR WORKMANSHIP. ORP PRODUCTS ARE WEATHER RESISTANT, BUT THEY ARE NOT SUBMERSIBLE. USE CARE WHEN REMOVING YOUR ORP PRODUCT FROM YOUR BIKE IN RAINY CONDITIONS. IF WATER ENTERS THE ORP PRODUCT’S MICRO-USB PORT, IT MAY NOT FUNCTION. THIS WARRANTY EXCLUDES WATER DAMAGE CAUSED BY EXCESSIVE OR IMPROPER EXPOSURE TO WATER.

THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE IS LIMITED TO THE TERM OF THIS WARRANTY. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.

  • Product model name
  • Proof of purchase (e.g., a scanned or photographed copy of your receipt or shipping package)
  • Description of issue

You may also call Customer Service at 503-869-1817 with this information. Upon verification of your claim, Orp will provide you with a return authorization number.

Once you’ve obtained a return authorization number, ship your defective Orp product, along with your return address, the return authorization number, and a copy of your proof of purchase, to:

We recommend insuring and tracking your package. Orp Industries is not responsible for lost or misdirected packages.

We will return your repaired product or a replacement via USPS. Please allow 1-2 weeks for delivery.

How State Law Applies To This Warranty
This warranty gives you specific legal rights, and you may also have other rights that vary from state to state. This warranty shall be governed by the laws of Oregon.

International Purchases
A separate warranty may be provided by international distributors for Orp products purchased outside the United States, depending on the country. If applicable, this warranty is provided by the local distributor, which may provide local service for your Orp product. Distributor warranties are only valid in the area of intended distribution. Devices purchased in the United States must be returned to Orp Industries in Portland, Oregon, for service.

Additional Information

Orpland reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is sold out, Orpland has the right to cancel the order and refund any amount paid in the best way. Orpland shall also notify the customer of equivalent replacement products if available.
